Legal aspects –
Your questions. Our answers.

Yes. Care in a private household is permitted in principle – provided it is organised correctly and properly implemented under employment law. This means the caregiver is not self-employed but a permanent employee – for example, of a Swiss company such as seniorencare24.

With posting, a caregiver is sent temporarily to Switzerland by a company based abroad. For care in a private household, this is not legally permitted if the right to give instructions (i.e. the right to decide how the work is done) lies with the household itself – which is almost always the case.

All our caregivers are employed on Swiss employment contracts, including social security, accident insurance, taxes and pay in line with legal requirements.

We work exclusively under a SECO licence for personnel leasing, and our registered office is in Switzerland.

Posting: The caregiver works on behalf of and under the direction of the foreign company. In practice, this is rarely legal for private households.

Personnel leasing: The caregiver is employed by a Swiss company but works in the client’s household. This is permitted – provided the company is licensed in Switzerland, as seniorencare24 is.

Yes. Anyone who obtains care staff through illegal placement or employs them without declaring them risks a fine of up to CHF 50'000.–.

That is why we advise caution with offers under CHF 5'000.– a month that claim to provide legal 24-hour care.

Because they:

  • live on site and work under instruction

  • do not set their own prices or bring their own infrastructure

  • work for only one household

Swiss law clearly classifies such working relationships as employment – with all the obligations that employment law places on the employer.

Look out for the following:

  • Registered office in Switzerland

  • SECO licence for personnel leasing

  • Permanent employment with payslips, social security contributions and insurance

  • No bogus self-employment or posting of workers

  • Transparent contracts

With us, it is simple: legal, verified and transparent – no ifs and buts.
